Acceptance of Terms

By downloading, installing, or using the Chitz application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. Chitz reserves the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Description of Service

Chitz is an iOS application that allows users to photograph questions and receive AI-generated answers ("Service"). The App relies on third-party artificial intelligence providers to generate responses. The Service is provided for informational and educational assistance purposes only.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

Acceptable Use

You agree that you will:

• Use the App only for lawful, personal, and non-commercial purposes.
• Not upload images containing illegal, harmful, obscene, or infringing content.
• Not attempt to reverse-engineer, decompile, or tamper with the App.
• Not use the App to circumvent academic integrity policies of your school or institution.
• Not use automated scripts, bots, or other tools to access the Service.
• Not resell, sublicense, or commercially exploit the App or its outputs.

AI-Generated Content Disclaimer

The answers and content generated by the App are produced by artificial intelligence and are provided for informational and educational assistance only. Chitz does not guarantee the accuracy, completeness, or reliability of any AI-generated response. You acknowledge that AI-generated content may contain errors, omissions, or outdated information. You should not rely solely on the App's output for academic submissions, professional advice, medical decisions, legal matters, or any situation where an incorrect answer could cause harm. Chitz is not responsible or liable for any decisions you make based on content generated by the App.

Intellectual Property

The App, including its design, code, branding, and all associated content created by Chitz, is owned by Chitz and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license to use it as described herein. You retain ownership of any images you capture. By submitting images through the App, you grant Chitz a limited, temporary license to process those images solely for the purpose of generating a response to your query.

Disclaimer of Warranties

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Chitz does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Chitz does not warrant that any AI-generated answer is accurate or appropriate for your needs.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHITZ AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CHITZ'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

Indemnification

You agree to defend, indemnify, and hold harmless Chitz and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any third-party rights.

Third-Party Services

The App relies on third-party AI providers to process images and generate responses. Your use of the App is also subject to any terms and policies imposed by Apple Inc. through the App Store. Chitz is not responsible for the acts or omissions of any third-party service providers.

Termination

Chitz reserves the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at Chitz's sole discretion. Upon termination, all licenses granted to you under these Terms will immediately cease.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the applicable courts of the United States.
